Fiduciary Services
Hourly fees can range from $125 to $295 per hour depending on the matter and the staff involved. Professional Fiduciary hourly rates range are $225 to $295 per hour and support staff, including bookkeeper hourly rates range from $125 – $200 per hour. If real property is sold, either commercial or residential, a 1% fee is assessed against the gross sales price.
Fees for ongoing trusts and post-death administration are determined on a case-by-case basis that could range annually from 1% to 2% of the trust or estate’s value or based on the language of the trust instrument or other operative document.
Statutory Probate Fees
4% on the first $100,000
3% on the next $100,000
2% on the next $800,000
1% on the next $9,000,000
0.5% on the next $15,000,000
For all amounts above $25,000,000, the court will determine a reasonable compensation amount.
In addition to statutory fees, pursuant to Probate Code§10801, extraordinary fees can be requested for services such as, but not limited to, tax issues, real property sales and litigation. Fees for extraordinary services are subject to court approval.
Expert Consulting/Witness Services
Expert Consulting fee – $395 per hour.
Expert Witness fee – $495 per hour which includes, but not limited to case review & research, expert report drafting, meetings with counsel, deposition preparation, deposition testimony, and travel time. Expenses to be reimbursed at the actual cost. Trial preparation and testimony fee is $550 per hour.
Expenses are billed at actual costs.
